Employment Laws in Ohio


Definition of employee. Employee means an individual employed by any employer, but not any individual employed in the domestic service of another.

Definition of employer. Employer includes the state, any political subdivision of Ohio, any person employing four or more persons within Ohio and any agent of an employer.

Prohibited employment discrimination. It is unlawful to discriminate in hiring or employment practices on the basis of an employee's or job applicant's race, color, religion, sex (including pregnancy, childbirth, and related medical conditions), national origin, disability, treatment for mental illness, age (40 and over) or ancestry.

Recordkeeping requirements. Prior to employment, employers may not make or keep a record of the race, color, religion, sex, national origin, handicap, age, or ancestry of an applicant.

Posting requirements. Every employer that is subject to the Fair Employment Practices Law must post in a conspicuous place on its premises a notice prepared by the Ohio Civil Rights Commission, setting forth excerpts of the law.
